By accessing rpstudiomcallen.com, purchasing a membership, Day Pass, or booking a class, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

RP Studio LLC offers the following membership plans:

All memberships are billed on the 1st of each month. Members who register mid-month will be charged a pro-rated amount for the remaining days of the current month.

4. Day Pass

A Day Pass grants access to RP Studio facilities and classes for one (1) calendar day — specifically the date of the first class booked after purchase. The Day Pass may not be used on any other date. Day Passes are non-transferable and all sales are final.

5. Class Bookings

• Class capacity is limited to 20 spots per session
• Only members with an active subscription or valid Day Pass may book classes
• RP Studio reserves the right to cancel or reschedule classes at any time
• Members are encouraged to cancel bookings as early as possible to free up spots

6. Conduct & Facility Rules

• Members and guests must treat staff and other members with respect at all times
• Proper athletic footwear is required at all times on the gym floor
• Equipment must be used properly and returned after use
• RP Studio reserves the right to revoke access without refund for violations of facility rules
• Disruptive, aggressive, or unsafe behavior will result in immediate removal

7. Liability Waiver

By using RP Studio LLC facilities, you acknowledge that physical exercise involves inherent risks including but not limited to injury, illness, or death. You voluntarily assume all such risks and release RP Studio LLC, its owner Roxana Gonzalez, employees, contractors, and agents from any and all claims, damages, or liabilities arising from your use of the facility to the fullest extent permitted by Texas law.

8. Indemnification

You agree to indemnify, defend, and hold harmless RP Studio LLC, its owner, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the facility, your violation of these Terms, or your violation of any rights of another person or entity.

9. Equipment & Safety Reporting

Members and guests are required to immediately report any damaged, broken, or unsafe equipment to RP Studio staff. Do not use equipment that appears damaged or unsafe. RP Studio LLC is committed to maintaining a safe facility and will address reported issues promptly. Failure to report known hazards may affect your ability to bring a claim related to that hazard.

All content on rpstudiomcallen.com including text, graphics, logos, and images is the property of RP Studio LLC and may not be reproduced without written permission.

12. Changes to Terms

RP Studio LLC reserves the right to modify these Terms at any time. Continued use of our services following any changes constitutes your acceptance of the new Terms.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas.

Membership fees are non-refundable under all circumstances, including but not limited to:

• Personal schedule changes or conflicts
• Relocation outside the McAllen area
• Medical conditions or injuries
• Dissatisfaction with services
• Unused membership time

Members on a 6-Month or Annual commitment who wish to cancel early will be charged an early termination fee equal to 50% of the remaining monthly payments owed under the agreement. This fee is due at the time of cancellation.

3. Day Pass

Day Passes are non-refundable and non-transferable. Once purchased, a Day Pass cannot be exchanged, transferred to another person, or applied toward a membership.

4. Personal Training

Personal Training plans are non-refundable. Unused sessions do not carry over beyond the billing month in which they were purchased.

5. Class Bookings

Individual class bookings are not subject to refunds. If RP Studio cancels a class, affected members will be notified and the booking will be released so the member may rebook another available session.

6. Termination by RP Studio

RP Studio LLC reserves the right to terminate any membership for violations of facility rules, unsafe behavior, or failure to pay. In the event of termination by RP Studio for cause, no refund will be issued for the remaining membership period.

Overview

This Gym Membership Agreement is made between RP Studio LLC, located at 5001 Pecan Blvd, Ste. 160, McAllen, TX 78501, owned and operated by Roxana Gonzalez, and the member whose information was submitted electronically at the time of registration. By completing the online registration and checking the acceptance box, the member agrees to all terms below.

1. Membership Plans & Fees

All memberships are billed on the 1st of each month. Members who register mid-month will be charged a pro-rated amount for the remaining days of the current month. The Flexible Monthly plan may be cancelled at any time without penalty.

2. Personal Training Add-On

Personal Training plans include full gym membership at no additional cost. Billing begins on the date of sign-up and renews monthly on that same date.

3. Payment Policy

All membership fees must be paid in accordance with the agreed schedule. Failure to make payments may result in suspension or termination of membership until payment is received. The rate agreed upon at registration will be honored for the duration of the commitment period.

4. Early Cancellation

Members on 6-Month or Annual plans who cancel before the end of their commitment period will be charged an early termination fee equal to 50% of the remaining monthly payments owed under the agreement.

5. Gym Rules & Conduct

• Proper use of all gym equipment at all times
• Respectful behavior toward staff and other members
• Maintaining cleanliness of the studio and equipment
• Wearing proper athletic footwear on the gym floor

RP Studio LLC reserves the right to terminate membership for failure to follow rules or for disruptive behavior. Termination does not relieve the member of any outstanding financial obligations.

6. Liability Waiver & Release

The member understands that participation in fitness activities, exercise programs, strength training, cardiovascular activities, group classes, and the use of exercise equipment involves inherent risks including but not limited to:

• Muscle strains, sprains, or tears
• Broken bones or ligament injuries
• Heart attack, stroke, or cardiovascular events
• Slips, falls, or accidents involving equipment
• Other serious physical injuries or death

To the fullest extent permitted by the laws of the State of Texas, the member releases, waives, discharges, and agrees not to sue RP Studio LLC, its owner Roxana Gonzalez, employees, contractors, trainers, agents, and representatives for any claims, damages, or causes of action arising out of or related to personal injury, illness, or property damage that may occur as a result of the member's use of the gym. This waiver applies even if caused in whole or in part by the negligence of RP Studio LLC or its staff, except where prohibited by law.

7. Medical Acknowledgment

The member affirms they are at least 18 years of age and physically capable of participating in exercise activities. Members are encouraged to consult a physician before starting any fitness program. RP Studio LLC is not responsible for health complications arising from participation.

8. Photo & Video Release

Members grant permission for RP Studio LLC to use photographs or videos taken within the facility for promotional purposes unless written notice is provided to opt out.

9. Indemnification

The member agrees to indemnify, defend, and hold harmless RP Studio LLC, its owner Roxana Gonzalez, employees, contractors, trainers, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to the member's use of the facility, violation of this Agreement, or violation of any rights of another person or entity.

Members are encouraged to provide an emergency contact name and phone number at the time of registration. In the event of a medical emergency, RP Studio staff will attempt to contact the designated person. RP Studio LLC is not liable for any failure to reach an emergency contact.

1. Agreement Overview

This Day Pass Agreement ("Agreement") applies to all individuals purchasing a one (1) day access pass to RP Studio LLC ("Gym"). By purchasing and/or using a Day Pass, the participant agrees to the terms below. By checking the acceptance box during the online purchase process, the participant confirms their electronic agreement to all terms, which constitutes a legally binding acceptance under the laws of the State of Texas.

2. Day Pass Access

A Day Pass grants the purchaser access to RP Studio LLC facilities for one (1) calendar day — specifically the date of the first class booked after purchase. The Day Pass may not be used on any other date. Access is subject to facility availability and class capacity limits. The Day Pass costs $25 and includes access to all available classes and facility areas on that day. Purchaser must be at least 18 years of age.

3. Rules of Use

Day Pass users agree to:

• Use all equipment properly and safely
• Follow all posted gym rules and staff instructions
• Respect other members and staff at all times
• Keep the cleanliness of the studio and equipment
• Report any damaged or unsafe equipment to staff immediately

4. Check-In Requirements

Valid government-issued photo ID may be required upon check-in at RP Studio LLC.

5. No Transfer / No Refund Policy

• Day Passes are non-transferable
• All sales are final and non-refundable, including unused access time
• Day Passes cannot be exchanged or applied toward a membership

6. Liability Waiver

By purchasing and using a Day Pass, the user acknowledges and agrees that:

• Physical exercise, training activities, and use of gym equipment involve inherent risks, including but not limited to muscle strain, injury, falls, cardiovascular events, or other health-related complications.
• The user voluntarily and knowingly assumes all risks, whether known or unknown, associated with participation in any physical activity at RP Studio LLC.
• The user understands that they are solely responsible for their own health, safety, and physical condition while using the facility.
• RP Studio LLC, its owners, operators, employees, independent contractors, and trainers are not responsible or liable for any injury, accident, illness, disability, death, loss, or damage that may occur before, during, or after use of the facility.
• The user releases, waives, and forever discharges RP Studio LLC and all associated personnel from any claims, demands, liabilities, or legal actions arising out of or related to gym use, including those caused by negligence to the fullest extent permitted by law.

7. Indemnification

The user agrees to indemnify, defend, and hold harmless RP Studio LLC, its owner Roxana Gonzalez, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to the user's use of the facility or violation of this Agreement.

8. Termination of Access

RP Studio LLC reserves the right to revoke access at any time without refund for:

• Unsafe behavior
• Violation of gym rules
• Disrespect toward staff or members
• Misuse of equipment or the studio

9. General Conditions

• Gym policies may be updated at any time without prior notice
• Users must be at least 18 years of age and physically able to participate in exercise activities

10. Voluntary Agreement & No Duress

The user confirms they are entering into this Agreement freely and voluntarily, without pressure or duress, and that they have had a reasonable opportunity to review all terms before accepting. The user is free to seek their own legal counsel to review this Agreement prior to acceptance.

11. Photo and Video Release

Users grant permission for RP Studio LLC to use photographs or videos taken within the facility for promotional purposes unless written notice is provided to opt out.

This Weekly Pass Agreement ("Agreement") applies to all individuals purchasing a Weekly Pass to RP Studio LLC ("Gym"). By purchasing and/or using a Weekly Pass, the participant agrees to the terms below. By checking the acceptance box during the online purchase process, the participant confirms their electronic agreement to all terms, which constitutes a legally binding acceptance under the laws of the State of Texas.

2. Weekly Pass Access

A Weekly Pass grants the purchaser access to 6 group class credits to be used within 7 consecutive days from the date of purchase. Credits are non-transferable and expire at the end of the 7-day period regardless of whether all credits have been used. The Weekly Pass costs $69 and includes full facility access for all available classes during the valid period. Purchaser must be at least 18 years of age.

3. Class Credits & Booking

• 6 group class credits included — one credit per class attended
• Credits must be used within 7 consecutive days from the date of purchase
• Unused credits expire at the end of the 7-day period — no refund or extension
• The gym is closed on Sundays — plan accordingly
• Class availability is subject to capacity limits of 20 spots per class
• Bookings must be made through the official RP Studio booking system

4. Rules of Use

Weekly Pass users agree to:

• Use all equipment properly and safely
